Many of the cases we are instructed in are judicial
review cases: cases brought against central or local government or
against other public bodies challenging their decisions, policies,
or failures to act.
The potential for judicial review to help resolve disputes, and the
way in which the judicial review process works, is not well known.
If you instruct us we will explain all of this to you, but to help
individuals and organisations (including advice workers) work out
whether judicial review may be appropriate our Public Law and Human
Rights team have produced some basic guides and case studies.
Guides
We have produced two guides:
- A Judicial Review: Procedure Guide – designed to provide
a basic overview of the main stages in a judicial review case.
To view the guide click
here. To download the guide as pdf click

- A Judicial Review: Advisers’ Checklist – aimed in
particular at advisers’ in advice agencies and other community
groups who want to know whether judicial review may be appropriate
in a particular case. To view the guide

Factsheets
If you work for a campaign group or an NGO you may also be interested
in the following factsheets:
- Funding public interest litigation’ – which provides
an overview of Protective Costs Orders and Conditional Fee Agreements.
To download click here.
- Advice and representation for organisations’ – which
provides practical tips on getting the most out of legal advice
and representation, based on our experience of advising campaign
groups and NGOs. To download click
here.
Case studies
We have also produced some case studies aimed at providing more information
about some of recent cases and to illustrate the potential uses of
judicial review:
Training notes
We run training sessions on public law issues and will periodically
add our training notes to the website. If you work with service-users
facing problems with public bodies and need information on making
complaints, going to the ombudsman or referring a possible judicial
review case to a solicitor, you may be interested in training notes
from a session we ran in May 2009. To download click
here.
More information
In addition to providing these guides we also offer free initial email
or telephone consultation to advice agencies, not-for-profits and
campaign groups needing help with potential judicial review cases.
